The issue of the particularisation of occupational health and safety breaches for prosecution purposes remains seemingly vexed and dependent upon the particular facts and circumstances of matter and the complaint. This section note comments on the resolution of the dispute over particulars in the matter of NK Collins Industries Pty Ltd v Twigg (No 2) (C/2009/56) and looks at the appeal relating to particularisation of the offence in Townsville Gymnastics Association v Coggins Inc (C/2010/67).
