Scope of Subtitle: [26.6.20] This Subtitle discusses the federal legislation concerning organisations. This includes consideration of the federal power to legislate for organisations (see [26.6.150]), how the legislation accommodates State-registered associations (see [26.6.160] and [26.6.180]–[26.6.200]) and international treaties relating to organisations: see [26.6.210]–[26.6.220]. This is followed by a discussion of the structural aspects of organisations, including their registration and cancellation (see [26.6.330]–[26.6.420]), rules (see [26.6.460]–[26.6.470] and [26.6.500]–[26.6.580]), membership (see [26.6.590]–[26.6.640]), democratic control including elections for office (see [26.6.650]–[26.6.750]), record and account keeping (see [26.6.760]–[26.6.910]) and amalgamation and withdrawal: see [26.6.920]–[26.6.1170]. The interaction between organisations and the workplace are covered, including representation orders (and freedom of association) (see [26.6.1280]–[26.6.1310]), rights of entry (see [26.6.1320]–[26.6.1390]), the role of organisations in industrial instruments (see [26.6.1410]–[26.6.1450]) and industrial action: see [26.6.1460]–[26.6.1510]. This area receives an unusual amount of legislative attention particularly when there is a change of government at federal level. There is a discussion of amendments affecting organisations introduced by successive governments from 2012 to 2017. This is discussed at [26.6.1530]. This includes a discussion of the regulation relevant to the Building and Construction Industry and the re-establishment of the Australian Building and Construction Commission by the Coalition federal government: see [26.6.1590].
